Terms of Service

1. Acceptance of Terms

By accessing or using FranReal’s services, platform, or electronic signature workflows, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

FranReal, LLC provides commercial real estate tenant representation services to franchisees, franchisors, and brokers. Our platform facilitates site searches, broker outreach, and electronic execution of real estate documents including Exclusive Right to Represent agreements and Letters of Intent.

3. Electronic Signatures

Documents executed through our platform via DocuSign are legally binding electronic signatures under the Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA). By signing electronically, you agree that your electronic signature has the same legal effect as a handwritten signature.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

5. Limitation of Liability

FranReal’s liability to you for any claims arising from use of our services shall not exceed the fees paid by you to FranReal in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

6. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes shall be resolved in Maricopa County, Arizona.
